Welcome to www.gentekcorp.com. This website is owned and operated by Gentek General Contractors LLC, including its Gentek Services division (“Gentek,” “we,” “our,” or “us”).

By accessing this website, submitting a service request, communicating with Gentek, or consenting to receive SMS messages, you agree to these Terms and Conditions.

1. Website Purpose

This website provides general information about Gentek’s commercial construction, general contracting, facility maintenance, repair, renovation, emergency-response, and project-management services.

Website content is provided for informational purposes only. Nothing on this website constitutes a binding estimate, proposal, warranty, construction agreement, or guarantee of service.

2. Service Areas and Availability

Gentek provides services in selected locations throughout the Northeast, Texas, and other approved service areas.

Service availability depends on location, technician availability, licensing requirements, project scope, site conditions, material availability, safety requirements, and scheduling.

Submitting a service request does not guarantee that Gentek will accept or perform the requested work.

3. Service Requests and Authorization

Customers may request service through the website, telephone, email, SMS, an approved work-order platform, or another authorized communication method.

Submitting a request does not create a binding contract or authorize Gentek to begin work.

Work is considered authorized only after Gentek receives an accepted estimate, signed proposal, purchase order, work order, written authorization, or other documented approval from the customer or the customer’s authorized representative.

The customer is responsible for providing complete and accurate contact, property, access, billing, purchase-order, and scope information.

4. Emergency and After-Hours Services

Gentek will make reasonable efforts to respond promptly to emergency and after-hours requests. Response and arrival times are estimates and are not guaranteed.

Response times may be affected by technician availability, weather, traffic, site accessibility, material availability, safety conditions, and circumstances beyond Gentek’s reasonable control.

Emergency and after-hours services may be subject to additional dispatch, trip, labor, equipment, material, and mobilization charges.

If a condition presents an immediate threat to life, health, public safety, or property, customers should first contact 911, the fire department, police department, utility provider, or other appropriate public authority.

5. Estimates and Pricing

Website content does not constitute a price quotation. Pricing will be established through a written estimate, proposal, rate agreement, work order, purchase order, or other service authorization.

Unless specifically stated otherwise, estimates are based on visible and reasonably accessible conditions at the time of inspection or review.

Estimates may exclude:

  • Concealed or unforeseen conditions

  • Code-required corrections that were not visible during the initial inspection

  • Permits, inspections, engineering, testing, or design services

  • Hazardous-material testing, removal, or remediation

  • Premium freight or expedited materials

  • Specialty equipment, lifts, scaffolding, or traffic control

  • Work requested outside normal business hours

  • Taxes and third-party fees

  • Repairs outside the approved scope

Material prices and availability may change before an estimate is accepted and materials are ordered. Any estimate-expiration period will be stated in the applicable proposal.

6. Change Orders and Additional Work

Work outside the original authorized scope requires additional written or documented authorization.

Additional charges may apply when Gentek discovers concealed damage, unsafe conditions, code violations, inaccessible areas, inaccurate information, customer-requested changes, or other circumstances that could not reasonably have been identified before work began.

When immediate action is necessary to protect people or property, Gentek may contact the customer or the customer’s designated representative for emergency authorization.

7. Customer Responsibilities

The customer is responsible for:

  • Providing safe and reasonable access to the property and work areas

  • Providing access to utilities, equipment rooms, rooftops, loading areas, and secured locations when required

  • Identifying the individual authorized to approve work and additional charges

  • Disclosing known hazards and unsafe conditions

  • Removing or protecting personal property near the work area

  • Providing accurate billing and purchase-order information

  • Obtaining owner, landlord, tenant, or property-management approvals when required

The customer must disclose known asbestos, lead, mold, hazardous materials, structural concerns, contaminated areas, active leaks, unsafe electrical conditions, or other potentially dangerous conditions before work begins.

Delays caused by unavailable access, inaccurate information, tenant restrictions, unsafe conditions, or actions of other contractors may result in additional charges and schedule adjustments.

8. Scheduling and Project Delays

Any stated arrival window, start date, project duration, or completion date is an estimate unless expressly guaranteed in a signed written agreement.

Gentek is not responsible for delays caused by weather, emergencies, labor shortages, material shortages, shipping delays, inspections, permitting agencies, utility companies, customer changes, concealed conditions, site-access restrictions, acts of government, or other circumstances beyond Gentek’s reasonable control.

9. Employees, Subcontractors, and Trade Partners

Gentek may perform services using its employees, subcontractors, suppliers, specialty contractors, and approved vendor partners.

Gentek may coordinate electrical, plumbing, HVAC, roofing, glazing, fire-protection, engineering, and other specialty services through appropriately qualified or licensed providers when required.

10. Payments

Deposits, progress payments, final payments, credit terms, and payment deadlines will be stated in the applicable estimate, invoice, proposal, purchase order, rate agreement, or contract.

Customers are responsible for paying approved charges according to the agreed payment terms.

Gentek may suspend nonemergency work when required deposits, progress payments, or past-due invoices remain unpaid.

Late charges, collection expenses, or attorney’s fees will apply only when included in the applicable agreement and permitted by law.

11. Cancellations and Rescheduling

Customers should provide notice as soon as possible when canceling or rescheduling an approved service call.

A cancellation or mobilization charge may apply when technicians have already been dispatched, materials have been ordered, equipment has been reserved, permits have been obtained, or subcontractors have been scheduled.

Special-order and custom materials may be nonreturnable or subject to restocking, handling, and delivery charges.

12. Workmanship and Manufacturer Warranties

Any applicable workmanship warranty will be stated in the written estimate, proposal, or contract for the project.

Manufacturer warranties are provided by the applicable manufacturer and remain subject to the manufacturer’s terms, limitations, registration requirements, and exclusions.

Unless otherwise required by law or stated in a signed agreement, warranties do not cover:

  • Normal wear and tear

  • Misuse, abuse, vandalism, or accidental damage

  • Failure to perform required maintenance

  • Preexisting or concealed conditions

  • Work modified or damaged by others

  • Customer-supplied materials or equipment

  • Manufacturer defects

  • Building movement or structural settlement

  • Water intrusion originating outside Gentek’s approved scope

  • Damage caused by weather, flooding, fire, power problems, pests, or other external events

13. SMS Terms of Service

Gentek uses SMS for conversational and informational communications with existing customers, employees, approved technicians, subcontractors, vendors, and other authorized business contacts.

SMS messages may concern:

  • Service requests

  • Work orders

  • Scheduling and appointment confirmation

  • Jobsite addresses and access information

  • Technician assignments and arrival updates

  • Approved rates and service authorizations

  • Project-status updates

  • Estimates and invoices

  • Required jobsite photographs and documentation

  • Job completion and customer support

Consent may be provided when a recipient initiates a text conversation, provides verbal consent during a telephone call, provides written consent during service authorization or onboarding, or selects an optional SMS-consent checkbox on a Gentek form.

By consenting to receive SMS messages from Gentek General Contractors LLC, you agree to receive conversational and informational text messages related to the matters described above.

Message frequency may vary. Message and data rates may apply.

Reply STOP to opt out of future SMS messages. Gentek will honor opt-out requests associated with recognized keywords, including STOP, END, UNSUBSCRIBE, and CANCEL.

Recipients who have opted out may reply START to resubscribe where supported.

Consent to receive SMS messages is not a condition of purchasing goods or services. Gentek does not send unsolicited marketing messages or use purchased contact lists for SMS campaigns.

Mobile telephone numbers, SMS opt-in information, and text-message consent will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Information may be provided to communication-service providers only as necessary to deliver and support Gentek’s messaging services.

13.1 SMS Consent Communication

Phone numbers and SMS consent obtained through Gentek’s opt-in process will not be sold or shared with third parties or affiliated companies for marketing or promotional purposes.

Consent to receive SMS messages is not a condition of purchasing goods or services.

13.2 Types of SMS Communications

After consenting to receive text messages from Gentek General Contractors LLC, you may receive conversational and informational SMS communications related to:

  • Service requests and updates

  • Scheduling and appointment reminders

  • Work orders and technician assignments

  • Jobsite information and arrival updates

  • Estimates and service authorizations

  • Billing inquiries and invoices

  • Project-status and completion updates

  • Follow-up messages and customer support

Gentek does not use purchased contact lists or send unsolicited SMS marketing messages.

13.3 Message Frequency

Message frequency may vary depending on the type of communication and the activity associated with your service request or work order.

Recipients may receive approximately 1 to 10 SMS messages per week during an active service request or project. Emergency services, scheduling changes, or active work-order coordination may require additional messages.

13.4 Potential Fees for SMS Messaging

Message and data rates may apply. Mobile carriers may charge fees for messages sent or received. Charges depend on the recipient’s mobile carrier, service plan, and whether messages are sent or received domestically or internationally.

Gentek is not responsible for charges imposed by a mobile carrier.

13.5 Opt-In Method

You may opt in to receive SMS messages from Gentek by:

  • Selecting the optional SMS-consent checkbox on an online form

  • Initiating a text conversation with Gentek

  • Providing express verbal consent during a telephone conversation

  • Providing written consent during customer, technician, vendor, or subcontractor onboarding

Website SMS-consent checkboxes are optional and are not preselected.

13.6 Opt-Out

You may opt out of Gentek SMS communications at any time by replying STOP to any received message.

After opting out, you will receive an opt-out confirmation and no further SMS communications unless you provide consent again.

Where supported, you may opt back in by replying START.

Other recognized opt-out keywords may include END, UNSUBSCRIBE, and CANCEL.

14. Photographs and Project Documentation

Gentek may take photographs or videos of jobsite conditions for estimating, safety, progress documentation, quality control, invoicing, insurance, and project-closeout purposes.

Gentek will not intentionally publish customer names, addresses, confidential documents, security information, or clearly identifiable private interior areas for marketing purposes without appropriate permission.

Nonidentifying project photographs may be used to demonstrate Gentek’s services and experience where permitted by the customer agreement and applicable law.

15. Website Communications and Security

Email, SMS, and website forms may not always be secure or delivered immediately.

Users should not submit Social Security numbers, complete banking credentials, credit-card numbers, alarm codes, medical records, or other highly sensitive information through the website, email, or SMS unless Gentek provides an approved secure submission method.

16. Intellectual Property

The Gentek name, logo, website design, photographs, graphics, written content, proposals, and other original materials are owned by Gentek or used with permission.

Website content may not be copied, reproduced, altered, republished, distributed, or used commercially without Gentek’s prior written authorization.

17. Third-Party Websites

This website may contain links to manufacturers, suppliers, social-media platforms, mapping services, or other third-party websites.

Gentek does not control and is not responsible for the availability, accuracy, security, content, or privacy practices of third-party websites.

18. Prohibited Website Use

Users may not:

  • Submit false, fraudulent, or misleading information

  • Impersonate another person or organization

  • Attempt to gain unauthorized access to the website or its systems

  • Upload malicious code or harmful content

  • Interfere with the website’s operation or security

  • Use the website for unlawful purposes

  • Violate Gentek’s or another party’s intellectual-property rights

19. Website Disclaimer

Gentek makes reasonable efforts to maintain accurate website information. However, Gentek does not guarantee that all content will always be complete, current, accurate, or free from technical errors.

Project photographs are examples of previous work and do not guarantee identical results for another property or project.

20. Limitation of Website Liability

To the fullest extent permitted by law, Gentek will not be responsible for indirect, incidental, special, or consequential damages arising solely from:

  • Use or inability to use this website

  • Reliance on general website information

  • Website interruptions or transmission failures

  • Unauthorized access caused by circumstances beyond Gentek’s reasonable control

  • Content or services provided by third-party websites

This section does not modify Gentek’s responsibilities under an executed project agreement and does not exclude liability that cannot legally be limited.

21. Separate Project Agreements

These website Terms do not replace any signed estimate, proposal, work order, purchase order, subcontract, construction contract, maintenance agreement, or vendor agreement.

If these Terms conflict with an executed project agreement, the executed project agreement will control regarding that project.

22. Governing Law

These website Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules, unless applicable law requires otherwise.

Project-specific services may be subject to the laws, licensing requirements, and regulations of the state where the work is performed. An executed project agreement may contain separate governing-law or dispute-resolution provisions.

23. Changes to These Terms

Gentek may update these Terms periodically. The updated version will be posted on this page with a revised effective date.

Changes to these website Terms will not retroactively modify an already executed project agreement.
